Privacy policy and use of cookies on the Funclip.pl website

This document refers to the processing and protection of personal data concerning users in connection with their use of the http://funclip.pl service (hereinafter referred to as “the Service”).

Prognity Sp. z o.o., the operator of the Service, respects the right to privacy of its users. In particular, it takes care of the protection of their personal data and applies appropriate organisational and technical solutions preventing interference in the privacy of users by third parties. Our actions are aimed at guaranteeing the user a feeling of complete security at the level appropriate to the applicable law, including:

  • Regulation (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (on the protection of individuals with regard to the processing of personal data and on the free movement of such data);
  • Act of 18 July 2002 on rendering services by electronic means;
  • The Telecommunications Law Act of 16 July 2004.

I. General information

  1. The controller of personal data processed within the Funclip.pl service is Prognity Sp. z o.o., Łódź, 90–254, ul. Piramowicza 9, District Court for Łódź Śródmieście, 20th Division of the National Court Register, KRS [National Court Register]: 0000354742, NIP [VAT]: 7252023240, REGON [National Official Business Register]: 100881256 – hereinafter referred to as a Controller.

  2. The Service shall perform the functions of obtaining information about users and their behaviour in the following manner:

    • By means of voluntary entered information in the forms;
    • By storing cookies on the user’s devices;
    • By collecting web server logs from the hosting provider.

II. Data collection:

Within the scope of using the Service by the user, we store http queries directed to the server. Browsed resources are identified by URL addresses and concern the following:

  • the public IP address of the user’s device from which the request was received;
  • the user’s station name – identification performed by the http protocol, if possible;
  • the user’s name given during the authorisation process;
  • the time of the request;
  • the first line of the http request;
  • http response code;
  • the number of data sent by the server;
  • the URL address of the website which was previously visited by the user (the so-called referrer link) – if the user accessed the Service using an external link;
  • information about the user’s web browser;
  • information about any errors which occurred during the HTTP transaction;
The above mentioned data are not associated with any specific person viewing the Service.

The services do not automatically collect any information other than that contained in cookies. Information collected in this way is used, among other things, as follows:

  • to manage the service;
  • to identify possible safety hazards;
  • to research the aggregated traffic of users within the Service and for statistical purposes, including the use of Google Analytics tools.
However, the user may be asked to provide the following personal data in order to fulfil the order for products offered by the Service within the scope of using the functionality of the Service:
  • first name and last name;
  • e–mail address;
  • the start number of the sports event.
Providing the above mentioned data is voluntary; however, without providing it, it may not be possible to use the Service in the scope of functionality that requires it (e.g. handling the order).

III. Data given in the order form

  1. The Service collects information voluntarily provided by the user in the form only for the purpose of fulfilling the order or, if the user consented, also for marketing purposes.
  2. Moreover, the Service may store information about the connection parameters (time, IP address).
  3. The data provided in the form are not made available to third parties, except with the consent of the user.
  4. The data provided in the forms may be transferred to the entities technically providing certain services; in particular, it concerns the provision of information to payment services or to other entities with which the Operator of the Service cooperates in this respect.

IV. Processing of personal data

The data collected through the Service concerning the user may be used in order to determine the adjustment of the content of the Service to the needs of the user and in order to respond to the request made by the User using the contact form.

The collected personal data shall not be transferred to international organisations or third countries. The personal data may be processed by other entities in accordance with the European or national law.

The personal data of user processed by the Controller through the Service are collected in order to perform the Agreement (services of generating and sharing personalised videos from sports events); the legal basis for the processing is the necessity of the processing to perform the Agreement (Article 6, section 1, letter b of the GDPR).

The personal data collected through the forms to which the User agreed are processed for the purpose and for the period necessary for the proper handling of the order. Details are specified in the relevant clauses contained under specific forms.

The Controller may also process personal data of participants of a sporting event obtained from the organiser of each sports event. In this case, the Operator of the Service (the Controller) may process personal data provided by the organiser of the sports event. The organiser of the event obtained prior consent of the participant of the sports event. The scope of the processed personal data shall include: first and last name, and start number.

The users have the right to access the contents of their data and to change or correct them, as well as to demand their deletion, or limitation of the processing of such data, and the right to transfer the data. The users have also the right to lodge a complaint with the supervisory authority in the field of personal data protection, i.e. the President of the Office for Personal Data Protection.

The processed personal data shall be made available to third parties only to the extent permissible by the law. The Controller may be obliged to provide information collected by the Service to authorised bodies on the basis of lawful requests to the extent resulting from the request.

V. Cookies

  1. This Service uses cookies.
  2. Cookies are computer data, in particular text files, that are stored in the user’s device and designed to use websites of the Service. Typically, cookies contain a website name, information about the time they are stored on the user’s device and a unique user ID.
  3. The entity placing cookies on a user's device and gaining access to these files is the Controller.
  4. Cookies are used for the following purposes:
    • to compile statistics which help to understand the way the Service users use websites in order to improve their structure and content;
    • to facilitate the user’s use of the Service while browsing it;
    • to subsequent associate the user in the event of re-connection of the Service with the device on which they were saved;
    • to adjust the content of the Service’s websites to the user’s specific preferences and optimising the use of the Service’s websites, tailored to the user’s individual needs;
  5. There are two main types of cookies used within the Service: session cookies and persistent cookies. Session cookies are temporary files that are stored on the user’s device until the user logs out, leaves the website or disables the software (closes a web browser). Persistent cookies are files that are stored on the user’s device for a period of time specified in cookies parameters or until they are deleted by the user.
    The Service may also use the following types of cookies:
    • “performance” – they collect information on how the Service’s websites are used;
    • “necessary” – they enable the use of services available within the Service;
    • “functional” – they enable remembering the settings selected by the user and personalising the user’s interface;
    • “first-party” – cookies placed by the Service;
    • “third-party” – cookies placed by websites other than the Service.
  6. The software used to browse websites (a web browser) usually by default enables storage of cookies on the user’s device. The Service users may change their web browser settings.   7. Disabling cookies may affect some of the functionalities available on the websites of the Service’s websites.
  8. Cookies placed on the Service user’s device may also be used by advertisers and partners cooperating with the Service operator.
